Terms of Service

The rules that apply when you use FlexiBudget.

These Terms of Service ("Terms") govern your use of FlexiBudget — the website at flexibudget.app, the application at my.flexibudget.app, and related services (together, the "Service"). The Service is operated by Sergei Krylov, a sole proprietor registered in the Polish CEIDG business register; full legal and postal details are on the Imprint.

Acceptance of these terms

By creating an account, logging in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you are using the Service on behalf of an organisation, you represent that you are authorised to accept these Terms on its behalf, and references to "you" include that organisation.

Your access and account

When you access the Service, you may be asked to provide certain personal information, including your contact information (such as your email address and optionally your name) and payment information (if you are purchasing a subscription). You represent and warrant that all information you provide to us is current, complete, and correct, and you agree to keep it up to date. All information you provide will be collected and used in accordance with our Privacy Policy.

You must be at least 16 years old to create an account. You are responsible for keeping your password and any access tokens confidential, and for all activity that occurs under your account. Please notify us using our Contact Information promptly if you suspect unauthorised access. You may only use the Service for yourself or for people on whose behalf you are lawfully acting; sharing a single account between multiple people is not supported and may lead to data inconsistency. We may suspend or terminate accounts that violate these Terms; see "Termination" below.

While we strive to offer you continuous access to the Service, the Service may be unavailable from time to time. We will not be liable if your access to or use of the Service is interrupted, or if any part of the Service is unavailable for a period of time. We also reserve the right to change the Service and any related features in our sole discretion.

Free and paid plans

FlexiBudget offers a free plan that covers the core features, and one or more paid plans with additional features or higher limits. The scope of each plan is described inside the application and on our website, and may change from time to time.

We intend to keep a free tier available, but reserve the right to adjust what is included in each plan. Changes will not retroactively remove content you have already created.

Billing, renewals and withdrawal right

Paid plans are billed through our third-party payment processor. By subscribing, you also agree to that payment processor's own terms applicable to the payment. Subscriptions renew automatically at the end of each billing period until cancelled. Prices include applicable VAT where required.

You can cancel a paid subscription at any time from the billing portal in the application. After cancellation, you retain access to paid features until the end of the current billing period; no partial refunds are issued for unused time, except where required by applicable law.

14-day right of withdrawal (EU consumers). If you are a consumer in the EU, you normally have 14 days to withdraw from a paid subscription without giving a reason (Directive 2011/83/EU). However, by starting to use paid features immediately after purchase, you expressly consent to immediate performance and acknowledge that your right of withdrawal is lost once the service has been fully performed. To exercise the right of withdrawal before that point, please contact us using our Contact Information.

If a payment fails, we may retry it, downgrade the account to the free plan, or suspend access to paid features until payment is resolved.

Content that you create in the Service (transactions, budgets, vehicle records, notes, and so on) belongs to you. You grant us a limited, worldwide, royalty-free licence to host, copy, transmit and display that content only to the extent necessary to operate the Service for you (for example: storing it on our servers, syncing it to your other devices, backing it up).

Our intellectual property

FlexiBudget, including its name, logo, wordmark, user interface, source code, designs, documentation and content, is owned by Sergei Krylov and protected by copyright, trademark and other intellectual property laws. "FlexiBudget" and the FlexiBudget logo are trademarks of Sergei Krylov.

These Terms do not grant you any licence to use our trademarks, brand assets, or source code beyond using the Service as intended.

Disclaimer — no financial advice

FlexiBudget is a personal budgeting tool. It is not a bank, a payment service, an investment adviser, an accountant, or a tax adviser. Information shown in the Service is provided for your own information. Any decisions you make based on it are your own responsibility, and you should consult a qualified professional for financial, tax, legal or investment advice.

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, to the fullest extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any data will be preserved without loss. You are responsible for keeping your own backups of important data.

Limitation of liability

To the fullest extent permitted by applicable law, our total aggregate liability for any and all claims arising out of or in connection with the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or (b) EUR 50.

We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits or excludes liability or rights that cannot be limited or excluded under applicable mandatory law. In particular, nothing in these Terms limits or excludes (a) liability for gross negligence, wilful misconduct, or death or personal injury caused by negligence; or (b) your statutory rights as a consumer under Polish or EU law, including the implied warranty for defects (rękojmia) and any rights under the Polish Consumer Rights Act.

Termination

You may stop using the Service and close your account at any time. The process for requesting deletion of your account and associated data is described in our Privacy Policy.

We may suspend or terminate your account, with or without prior notice, if (a) you materially breach these Terms; (b) your use of the Service exposes us or other users to legal, security, or financial risk; or (c) we are required to do so by law. Where reasonably possible, we will give you an opportunity to export your content before termination.

The provisions of these Terms that by their nature should survive termination — including those concerning the licence granted under "Your data" for content still hosted on our systems, "Our intellectual property", "Disclaimer", "Limitation of liability", and "Governing law and disputes" — will continue to apply after termination.

Changes to these terms

We may update these Terms from time to time to reflect changes to the Service, our practices, or applicable law. Whenever we make changes, we will update the "Last modified" date at the top of this page. For material changes, we will also notify registered users by email before the changes take effect.

Your continued use of the Service after an updated version of these Terms takes effect constitutes your acceptance of it. If you do not agree with a change, you may stop using the Service and close your account as described in our Privacy Policy.

Complaints

If you have a complaint about the Service or these Terms, please contact us using our Contact Information. Please include a description of the issue and, where applicable, the email address associated with your account so that we can investigate.

We aim to acknowledge complaints within 7 days of receipt and to respond substantively within 14 days. Where a complaint cannot reasonably be resolved within 14 days, we will inform you of the expected timeframe and the reasons for the extension. Our response will be sent to the contact details you provide.

Governing law and disputes

These Terms and any dispute arising out of or in connection with them or with the Service are governed by the laws of the Republic of Poland, without regard to its conflict-of-laws rules. Where you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence.

Disputes will be submitted to the competent Polish courts, unless mandatory law grants exclusive jurisdiction elsewhere. We do not currently participate in alternative dispute resolution (ADR) proceedings before a consumer arbitration board. Polish consumers may nevertheless contact the Office of Competition and Consumer Protection (UOKiK) or the Trade Inspection (Inspekcja Handlowa) for information.
